What is copyright?
According to Article 1259 of the Russian Federation Civil Code (hereinafter – the Code), copyrights are recognized as intellectual rights to published or unpublished works of science, literature and art expressed in any objective form, including written or oral forms (in the form of a public pronouncement, public performance, and in another similar form), in the form of an image, in the form of a sound or video recording or in a three-dimensional form.
What works are protected by copyright?
Works of science, literature, and art are protected results of intellectual activity. Objects of copyright also include computer programs, which are protected as literary works.
When does copyright arise?
Copyright in a work of science, literature, and art arises due to the fact of its creation. No registration of the work and any other formalities are required for the creation, exercise, and protection of copyright.
Who is recognized as the author of a work?
According to Article 1257 of the Code, the author of a work of science, literature, or art is recognized as the citizen whose creative work it was created.
What rights does the author of a work have?
The author of the work owns property and non-property rights. Property rights include the exclusive right to a work, which is valid throughout the life of the author and 70 years after his death. Non-property rights include, in particular, the right of authorship (the right to be recognized as an author of a work) and the author’s right to a name (the right to use or allow the use of a work under his/her own name, under a pseudonym or anonymously), which are inalienable and non-transferable and are protected indefinitely.
