The best way to prevent import of counterfeit products into Russia is to enter a trademark into the Customs Register of IP Objects.
The Customs Service shall make arrangements for protection of IP rights connected with suppression of unlawful crossing of the customs border by the counterfeit goods. Legal protection at customs is provided to copyright, trademarks and appellations of origin which are entered into the Customs Register of Objects of IP Rights (hereinafter referred as “Customs Register”). However, the Russian Customs Service co-operates with the Russian Patent and Trademark Services and notifies the trademark holders or holders of right to the appellation of origin (their trademark attorneys) if they reveal the counterfeit goods docketed with the registered trademark or appellation of origin either on the borders or in the Russian shops.
Recordal of IP objects into the Customs Register allows the Customs Service to immediately notify the IP right holder on the revealed counterfeit goods by e-mail, and the trademark holder in its turn can reply to the Customs Service request within the prescribed terms.
Maximum term of Recordal of an IP object into the Customs Register is 2 years (but no longer than a term of validity of IP object), this term can be further renewed. The Customs Register is available for the public on www.customs.ru.
