IP Court: trademark challenge by former group participant deemed unfair

On May 27, 2025, the Russian Intellectual Property Court in case No. SIP-522/2024 rejected the claim to invalidate Rospatent’s refusal to cancel trademark protection.

The Court held that a party previously part of the group for whose benefit the marks were developed and used cannot later challenge them independently. Such conduct was found to be an abuse of rights and contrary to the principle of good faith.
