IP Court Presidium Clarifies Rules for Amending Trademarks

The Presidium of the Intellectual Property Court (IP Court) clarified conditions for trademark amendments in its Review No. 1/2025 (November-December 2024).

In case No. SIP-471/2024 dated 02.12.2024, Rospatent denied the removal of the letter “Ч” from the trademark «КЕБРАЧЧО» (a Russian word stylized as “KEBRACHCHO”), as it significantly alters its perception. The Presidium upheld this, noting amendments are allowed only if designations remain legally identical (details).

In case No. SIP-111/2024 dated 14.11.2024, the court overturned Rospatent’s rejection of replacing a stylized “J” with “T” in the service mark “DELIGHT.” The verbal element remained identical (“DELIGHT”), and stylization may create a combined mark (details).
