The new Law No. 194-FS dated July 23, 2013 stipulates several amendments to the Russian Code On Administrative Offences. Namely, Art. 14.10 “Illegal use of trademark” has been supplemented by part 2, separating production for the purpose of sale and sale of counterfeit goods from other kinds of illegal use of the trademark.
An amount of a fine for such offences will depend on a price of the seized goods, but no less than RUB 2 000 for the physical persons, RUB 20 000 for the officers and RUB 40 000 for the legal entities.
Part 1 of Art. 14.10 stipulates penalty for “illegal use of trademark” (except for the events mentioned in part 2 of the Article) like exhibiting, storage, transportation, import of the counterfeit goods, the illegal use of the trademark in performing works and providing services, in advertisement, on the Internet, in a domain name.
The amendments to Art. 14.10 of the Russian Code on Administrative Offences will come into force on August 3, 2013.
